By sharing UGC, users agree to abide by our community guidelines and ensure their contributions are respectful, constructive, and legal.
2. Content Responsibility: The creator of UGC is fully responsible for their content. While we strive to maintain a safe and respectful space, we do not control or endorse user content and cannot guarantee its accuracy, integrity, or quality. Users must ensure their content does not violate any laws or rights.
3. Rights Granted: By posting content on Area Volleyball, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any form. You retain ownership of your UGC, but you allow us the flexibility to ensure that Area Volleyball can continue to provide high-quality services to all users.
4. Prohibited Content: We are committed to fostering a positive and safe environment. Users must not post content that is illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise harmful to third parties or objectionable. We reserve the right to remove UGC that violates these standards or our Terms of Use, and to take action against offending users.
5. Content Moderation: We are dedicated to maintaining a respectful and safe community where users feel free to express themselves. To support this commitment, we reserve the right to moderate, remove, or edit content that violates our community guidelines or Terms of Use.

Prohibited Uses

1. Automated Access: Users are prohibited from accessing Area Volleyball with any robot, spider, scraper, or any other automated means intended for any purpose without our express written permission. Additionally, users must not:
   • Bypass our robot exclusion headers or other measures we may use to prevent or restrict access to Area Volleyball.
   • Take any action that imposes, or may impose, in our sole discretion, an unreasonable or disproportionately large load on our infrastructure.
   • Interfere or attempt to interfere with the proper working of the site or any activities conducted on the site.
2. Spam and Solicitation: Users must not use Area Volleyball to transmit spam, including unsolicited promotions or advertisements, or solicitations of any kind. This includes spamming through private messaging, comments, forums, or any other communication channels provided by Area Volleyball.

   • Attempting to interfere with service to any user, host, or network, including, without limitation, via means of submitting a virus to Area Volleyball, overloading, "flooding," "spamming," "mailbombing," or "crashing."

Violations of system or network security may result in civil or criminal liability. Area Volleyball will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

1. Private Messaging: Area Volleyball provides a private messaging feature allowing users to communicate privately. Users are expected to use this feature responsibly and not to send spam, illegal content, or harass other users.
2. Review of Messages: Area Volleyball reserves the right to review messages sent through our platform in specific and limited circumstances. Such reviews may occur:
   • As part of an investigation into reported misuse of the messaging system, including but not limited to harassment, spam, solicitation, illegal activities, or breaches of our Terms of Use.
   • Conduct analyses of the types of messages sent through our platform to identify trends, common issues, and areas for improvement
   • When required by law, such as in response to a court order or other legal process.

Dispute Resolution

At Area Volleyball, we aim to address and resolve issues and disputes in a fair, effective, and efficient manner. If a dispute arises from or relates to the use of our platform, we strongly encourage the parties involved to contact us directly to seek a resolution.

If the dispute cannot be resolved through direct communication, we then recommend the following dispute resolution process:

1. Negotiation: Both parties agree to attempt to resolve the dispute through good faith negotiations within a specific timeframe (e.g., 30 days).
2. Mediation: If negotiations fail, both parties agree to enter mediation, facilitated by a neutral third-party mediator, to reach a settlement. The costs of mediation will be shared equally between the parties, unless otherwise agreed.
3. Arbitration: Should mediation fail to resolve the dispute, both parties agree to submit the dispute to binding arbitration. The arbitration will be conducted under the rules of the American Arbitration Association, and the decision of the arbitrator(s) will be final and binding.

This dispute resolution process shall not apply to legal actions initiated by Area Volleyball related to intellectual property rights infringement, theft, piracy, or unauthorized use of our platform. Any claim or dispute must be filed within one (1) year after such claim or dispute arose, regardless of any statute or law to the contrary.

By agreeing to these Terms of Use, you waive any rights to participate in a class action lawsuit or class-wide arbitration against Area Volleyball and its affiliates.
